Under the Matt Haller Act (SB 1852), the owner of an EO plant previously under a Seal Order, must apply for a modification construction permit and that permit must include a limit on EO at the source. In short, under the new law and if the permit was approved, it would allow Sterigenics to again use the chemical at its plant, but the company would first have to create new systems to capture the ethylene oxide gas. As such, the Illinois EPA would have to approve that system with a construction permit. Sterigenics filed their permit on June 24th, which was made public on July 15th. Public Comment will be accepted until August 15, 2019. State law requires a decision within 90 days of the application being submitted or permit is issued by default.
If the permit is denied by the IEPA, Sterigenics May appeal to the Pollution Control Board. There were at least 200-300 area residents in attendance, and public comment was limited to 2 minutes.
